Terms of service

Effective November 7, 2026 · Version 2026-11-07

These Terms are a contract between you and Moncors. They limit what Moncors owes you and what you can claim against it, especially in sections 5, 12, 13, 14, 15 and 16. Please read those sections closely.

1. Who we are and what these Terms cover

Moncors is operated by Puralico, LLC, doing business as Moncors (“Moncors,” “we,” “us”). These Terms apply to moncors.com, the Moncors applications, and everything we provide through them (the “Service”). “Moncors Parties” means Moncors; its owners, members, managers, officers, employees, contractors and agents; its affiliates; its licensors and service providers; and the successors and assigns of each.

By creating an account, accepting an invitation, or using the Service, you agree to these Terms and the Privacy Policy. If you do not agree, do not use the Service. If you are under 18, your parent or guardian agrees to these Terms for you as described in section 3.

If you train with a coach through Moncors, you also have a separate Client Agreement, Assumption of Risk and Release (the “Coaching Agreement”). These Terms cover the software; the Coaching Agreement covers the training. Both apply, and each is enforceable on its own.

2. What Moncors is, and what it is not

Moncors is software for delivering training programs, logging workouts, and tracking nutrition and progress. That is all it is.

Moncors does not provide medical advice, diagnosis or treatment. It is not a medical device, a healthcare service, or a substitute for a qualified professional. Nothing in the Service (no program, target, calculation, chart, flag, alert or coach note) is medical advice.

Programs, nutrition targets and other training content are written by coaches or produced by calculation. We do not review or approve them, and we do not verify that they are safe, suitable, accurate or appropriate for you.

Features that flag missed logging or stalled progress are conveniences. They may be wrong, late or absent. They do not monitor your health, and we have no duty to watch, detect or respond to anything you log or fail to log.

Consult a qualified healthcare provider before starting any exercise or nutrition program. If you have pain, dizziness, shortness of breath or any symptom that concerns you, stop and get medical attention. In an emergency, call emergency services. Do not use the Service to seek help.

3. Eligibility, accounts and minors

Moncors is invite-only. You cannot create an account without an invitation from a coach using the Service.

You must be at least 13. We do not allow accounts for anyone under 13, and we reject a date of birth that shows someone is under 13. If we learn an account belongs to someone under 13, we will delete it and its data.

If you are 13 to 17, your account stays locked until a parent or legal guardian completes our consent process. By giving consent, the guardian:

  • agrees to these Terms, the Privacy Policy and the Health Data Consent, for themselves and, to the fullest extent the law allows, on behalf of the minor;
  • confirms they have legal authority to do so;
  • accepts responsibility for the minor's use of the Service and compliance with these Terms; and
  • gives the assumption of risk and release in section 13 for themselves and on behalf of the minor.

A guardian may withdraw consent at any time. Withdrawing consent locks the account immediately.

You agree to give accurate information and keep it current. You are responsible for your password and for everything that happens under your account. Tell us at hello@moncors.com if you think someone else has access.

4. Your responsibilities and acceptable use

You agree not to:

  • use the Service unlawfully, or to harass, threaten or harm anyone;
  • give false health, age or identity information;
  • access or try to access an account that is not yours;
  • probe, scan or test the security of the Service, or get around any access control or rate limit;
  • scrape, crawl or bulk-extract data from the Service;
  • reverse engineer or try to derive the source code, except where the law allows it regardless of contract;
  • upload malware, or anything designed to disrupt or damage the Service;
  • impersonate anyone or misrepresent your relationship to a person or organization;
  • upload content you do not have the right to upload, or that infringes someone's rights;
  • upload an image of anyone other than yourself;
  • resell, sublicense or commercially redistribute the Service without our written permission; or
  • use the Service to build a competing product or to train a machine-learning model of your own.

We may investigate violations, remove content, and suspend or terminate an account, without warning.

5. Your content and our right to use it

5.1 What this covers. “Your Content” means everything you, your guardian or your coach submit to or create in the Service: training logs, program history, body measurements, nutrition entries, check-ins, messages, notes, photos, and anything else. “Derived Data” means anything generated from Your Content, such as totals, trends, scores, flags and model outputs. “Usage Data” means information about how the Service is used, such as device, log and interaction data.

5.2 Ownership. You keep whatever ownership rights you have in Your Content. Moncors owns the Service, Derived Data, Usage Data, De-identified Data (section 5.4), and every model, analysis and insight we create.

5.3 License to Moncors. You grant Moncors a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to host, store, reproduce, process, analyze, modify, adapt, create derivative works from, combine with other information, transmit, display and otherwise use Your Content, in our discretion, for these purposes:

  • providing, operating, maintaining, securing and supporting the Service;
  • improving, testing, researching and developing the Service and new products and services, including training, testing and improving machine-learning and artificial-intelligence models;
  • analytics, measurement, personalization and business operations;
  • communicating with you, including about Moncors' services;
  • creating De-identified Data and using it for any purpose;
  • complying with law, enforcing our rights and protecting safety; and
  • any other purpose described in the Privacy Policy, or for which you or your guardian give consent.

You also grant this license for Derived Data and Usage Data that relate to you, and our service providers may exercise it on our behalf.

5.4 De-identified Data. We may create aggregated or de-identified information from Your Content that does not reasonably identify you (“De-identified Data”). We own it, and we may use, share, license and sell it for any purpose, forever. We will take reasonable measures to keep it de-identified and will not try to re-identify it, except as the law allows.

5.5 How long the license lasts. For identifiable Your Content, the license lasts while we hold it and ends when it is deleted or your account is closed, except for (a) copies in backups until they age out, (b) copies we must keep by law or to defend claims, (c) Derived Data and De-identified Data, and (d) models and analyses already trained or created using Your Content, which we do not have to retrain or unwind.

5.6 Uses that need separate permission. Even with this license, we will not (a) sell identifiable health information or any minor's personal information, or share either for targeted advertising, or (b) publicly show a person's name, photo, likeness or identifiable results in marketing, unless that person (or a minor's guardian) gives separate, specific written authorization. Where the law requires a separate consent for any other use, we will ask for it, and that consent governs that use.

5.7 Your promises about Your Content. You promise that you have the right to submit Your Content and to grant this license, and that what you log is accurate. Your coach adjusts your program based on it, and inaccurate logging can lead to programming that is wrong for you.

5.8 Feedback. If you send us ideas or suggestions, we may use them without limit and without paying you.

6. Coaches and clients

Coaches using Moncors are independent. They are not our employees, agents or partners. We do not supervise, endorse, certify or verify any coach's credentials, and we are not responsible for what any coach does or fails to do.

If you are a client, your coaching relationship is between you and your coach. We are not a party to it and are not responsible for the quality, safety or suitability of anything your coach programs for you.

If you are a coach, you are responsible for your own licensing, certification, insurance and legal compliance, including scope-of-practice rules and any rules for working with minors. You are responsible for the programs you write, for getting the waivers and consents you need from clients, and for handling client information lawfully. You grant Moncors the license in section 5.3 for the programs and other content you submit, and you agree to defend and indemnify the Moncors Parties against claims arising from your coaching services or your handling of client data.

Where a coach is also an owner or operator of Moncors, that person acts in two separate capacities, and the protections these Terms give the Moncors Parties apply to them in both.

7. Our intellectual property

The Service, including its software, design, exercise library, coaching cues, and the Moncors name and logo, belongs to us or our licensors and is protected by law. We grant you a limited, revocable, non-transferable license to use the Service for its intended purpose while your account is active. Nothing else is granted. A training program your coach writes belongs to your coach, subject to section 5.3.

8. Third-party services

The Service runs on tools provided by third parties, uses third-party data (including nutrition and barcode databases), and may link to third-party sites. We do not control them and are not responsible for their content, accuracy, practices or availability. If you get the Service through an app store, that store's terms also apply to you. Your use of any third-party service is governed by that party's terms.

9. Fees

The Moncors app is included with coaching and has no separate charge. Coaching fees, cancellation and refunds are agreed directly between you and your coach (for a client under 18, with their parent or guardian).

10. Changes to the Service and these Terms; notices

We may change, suspend or discontinue any part of the Service at any time, without liability to you. We may also update these Terms. If a change is material, we will give notice by email or in the app before it takes effect (to the guardian, for a minor's account). Continuing to use the Service after that means you accept the new Terms. If you do not accept them, stop using the Service and close your account.

You agree to receive notices from us electronically, including by email to the address on your account or by posting in the app. A notice is effective when we send or post it. Closing your account withdraws this agreement for future notices.

11. Termination

You can stop using the Service and close your account at any time by writing to hello@moncors.com.

We may suspend or end your access at any time, with or without cause and with or without notice, including if you violate these Terms, if your coaching relationship ends, or if we change or discontinue the Service. We are not liable to you for doing so.

When your access ends, your license to use the Service ends immediately. We will keep or delete your data as described in the Privacy Policy. Sections 2, 5, 6, 7, 12, 13, 14, 15, 16 and 18 survive termination.

12. Disclaimers

THE SERVICE, AND ALL CONTENT, PROGRAMS, TARGETS, CALCULATIONS AND FEATURES IN IT, ARE PROVIDED “AS IS” AND “AS AVAILABLE.” YOU USE THEM AT YOUR OWN RISK. TO THE FULLEST EXTENT PERMITTED BY LAW, THE MONCORS PARTIES DISCLAIM ALL WARRANTIES AND CONDITIONS, EXPRESS, IMPLIED OR STATUTORY, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT, AND ANY ARISING FROM COURSE OF DEALING OR USAGE.

Without limiting that, the Moncors Parties do not promise that:

  • the Service will be uninterrupted, secure or error-free, or that any defect will be fixed;
  • your data will not be lost, corrupted, accessed or disclosed without authorization;
  • any program, target, calculation, nutrition figure, alert or flag is accurate, complete, safe or suitable for you;
  • any coach is qualified, careful or insured; or
  • you will get any result, or avoid any injury or harm.

No advice or information from us creates a warranty. Some places do not allow certain warranty disclaimers, so parts of this section may not apply to you.

13. Assumption of risk and release

13.1 Risks you accept. Exercise and changes to eating carry real risk of injury and illness, including serious and permanent injury, and in rare cases death. You (and your guardian, if you are a minor) understand this and voluntarily assume all risks that arise from using the Service and from any training, program, nutrition target or advice delivered through it, whether or not a Moncors Party contributed to them. These include unsuitable or inaccurate programming, errors in calculations or data, and the failure of any feature.

13.2 Release. To the fullest extent permitted by law, you release, waive and discharge the Moncors Parties from, and promise not to sue them for, any and all claims, demands, losses, damages and causes of action of any kind, known or unknown, arising out of or related to the Service or your use of it. This includes claims for bodily injury, illness, emotional distress, death, property damage, financial loss, and loss of or unauthorized access to data, and it includes claims based on the ordinary negligence of any Moncors Party. You give this release for yourself and your heirs, executors and personal representatives. If you are a minor, your guardian gives it for themselves and on behalf of you and your heirs, to the fullest extent the law allows.

13.3 What it does not cover. This section does not release claims for gross negligence, recklessness, willful or wanton misconduct, intentional wrongdoing or fraud, or any claim that the law does not allow to be released.

13.4 Relationship to the Coaching Agreement. The release in this section and the release in the Coaching Agreement are separate. Each is enforceable on its own, and neither narrows the other.

13.5 You understand this. You have read this section. You understand it gives up legal rights, including the right to sue for ordinary negligence, and you agree to it voluntarily.

14. Limitation of liability

14.1 No indirect damages. TO THE FULLEST EXTENT PERMITTED BY LAW, THE MONCORS PARTIES ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DATA, LOSS OF GOODWILL OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATED TO THE SERVICE, EVEN IF WE WERE TOLD THEY WERE POSSIBLE.

14.2 Cap. TO THE FULLEST EXTENT PERMITTED BY LAW, THE TOTAL LIABILITY OF ALL MONCORS PARTIES TOGETHER, FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THE SERVICE OR THESE TERMS, IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID MONCORS FOR THE SERVICE IN THE TWELVE MONTHS BEFORE THE CLAIM AROSE, OR (B) ONE HUNDRED U.S. DOLLARS ($100). Bringing several claims does not raise the cap.

14.3 Every legal theory. These limits apply whatever the legal theory (contract, tort, negligence, strict liability, statute or anything else) and even if a limited remedy fails its essential purpose.

14.4 Time limit. To the extent the law allows, any claim arising out of or related to the Service or these Terms must be filed within one year after it arises, or it is barred.

14.5 What it does not cover. Sections 14.1 and 14.2 do not limit liability for gross negligence, willful misconduct or fraud, or anything else the law does not allow to be limited.

14.6 Basis of the bargain. These limits are part of why the Service is offered on its current terms. Some places do not allow certain limitations, so parts of this section may not apply to you.

15. Indemnification

You agree to defend, indemnify and hold harmless the Moncors Parties from any claim, loss, liability, damage or expense, including reasonable attorneys' fees, arising out of or related to:

  • your use of the Service, or your guardian's or your minor child's use of it;
  • Your Content, including inaccurate or incomplete health information;
  • your violation of these Terms or of anyone's rights or any law; or
  • a claim by a family member, heir, insurer or other third party that depends on an injury or loss to you.

If you are a minor, your guardian gives this indemnity.

16. Governing law and disputes

16.1 Law. These Terms are governed by the laws of the State of Ohio and applicable federal law, without regard to conflict-of-laws rules.

16.2 Notice first. Before filing any claim, you must send a written description of it to hello@moncors.com and give us 30 days to resolve it.

16.3 Courts. Any dispute arising out of or related to these Terms or the Service must be brought only in the state or federal courts located in Franklin County, Ohio, and you consent to their jurisdiction and venue.

16.4 No jury. Each party waives any right to a jury trial.

16.5 No class actions. Each party may bring claims only on an individual basis, and not as a plaintiff or class member in any class, collective, consolidated or representative proceeding. If this waiver is found unenforceable for a claim, that claim must be brought in the courts named above and not in arbitration.

16.6 Our remedies. We may seek an injunction or other equitable relief in any court to protect our intellectual property or the security of the Service.

17. Privacy, health data and communications

The Privacy Policy explains how we collect and use information, including health information. Where the law requires separate consent for health information or for a minor's information, we collect it through the Health Data Consent, which is part of the Coaching Agreement process. We may send you service messages by email or in the app. You can opt out of marketing emails at any time; we send text messages only with your consent.

18. General terms

  • Layered protection. Each disclaimer, release, limit and waiver in these Terms is separate and independent. If one is unenforceable, the rest stay in effect.
  • Severability. If any provision is unenforceable, it is changed to the minimum extent needed to make it enforceable, or removed, and the rest stays in effect.
  • No waiver. Our not enforcing a provision does not waive it.
  • Assignment. You may not assign these Terms. We may assign them, including in a merger, acquisition or sale of assets.
  • Events beyond our control. Neither party is liable for delay or failure caused by something outside its reasonable control.
  • Entire agreement. These Terms, the Privacy Policy, the Health Data Consent and the Coaching Agreement are the entire agreement between us about the Service and replace anything earlier. If they conflict, the Coaching Agreement governs the training itself, these Terms govern the software, and on any other point the provision more protective of the Moncors Parties controls, to the extent the law allows.
  • Beneficiaries. The Moncors Parties are intended beneficiaries of sections 12 to 16. These Terms create no other rights for anyone who is not a party.
  • No partnership. Using the Service does not make you our employee, agent, partner or joint venturer.
  • Interpretation. Headings are for convenience. “Including” means “including without limitation.” These Terms are not read against us because we wrote them.
  • Compliance. You may not use the Service where doing so would violate U.S. export or sanctions laws.
